The Growth Policy Repeal that stopped the unconstitutional ZONING is only good until Nov. 2nd. Starting November 3, 2010, you will most likely see a push to restart the zoning process.

You are probably saying to yourself: how could the zoning push possibly be back, the Republicans are going to be back in control?  If you read the material in “Also from the Desk of Dan Cox” below, it lays out how much resistance we got from both parties when we wanted to protect our property rights by stopping the zoning process.

Still not convinced?  Ask yourself why the Republican educational arm, the North Valley Pachyderm club scheduled Stewart Brandborg, President of Bitterrooters for Planning to come talk about why we need zoning?  Stewart did cancel several times, even though Dave Hurtt assured him he would only be questioned by Dave himself.  This was in my opinion an attempt to sway all of the Republicans back towards zoning.
Since Stewart Brandborg cancelled they were unable to use good cop/bad cop to get their message across, now they have resorted to pushing the issue openely themselves.  Here (as well as above) is this week’s invitation to the Republican club, it speaks for itself.

This is a Republican club and all of their guest speakers are Republicans.  Don’t be duped again.  These guys are not the friends of liberty.  I am sure they will try to soft sell it by saying that we need a growth policy in order to get funding.  Why would we give up our property rights for funding?  The real reason they want a growth policy and zoning, is so their buddies can benefit from a law that says if you have a growth policy the government can subsidize your development and give you an exemption from the costly and time consuming subdivision review process.
If they can get countrol of the county commissioners office they can also implement zoning that would restrict their competition from developing.  Then they can buy their competitors land for pennies on the dollar and have it re-zoned for development.  This of course creates a financial windfall for the victors.  It is also the main principle in facism.  They are writing these benefits into the subdivision regulations revision as we speak.  You will hear them say something along the lines of “promoting things we like, instead of penalizing what we don’t like.” The new subsidies are no good to them without the growth policy in place by law, because it is the trigger for the financial benefits that they would like to get from your tax money.  I am personally not against people developing land, but I won’t trade our property rights for any special interests.
Don’t get me wrong, there were lots of great Americans who fought for property rights with every political affiliation you can think of including Republican.  This doesn’t change the fact that almost everyone in elected office from both parties want to steal your property rights; that is their track record.

They may claim they are finally listening, but actions speak louder than words.  The contract for America by Newt Gingrich was broken right after you re-elected them all back to office.  This is kind of like the Charlie Brown cartoon where the character pulls the football away every time he goes to kick it.  This of course makes him fall to the ground and get hurt.  Every time he gets back up he is reassurred that it won’t happen again.  There might be a lesson to be learned here.

The real reason I am running for office:

It has been claimed by some that I am running for office to help get Democrats elected.  This is far from the truth and immaterial, since the Republican incumbents in this valley vote so similarly you can hardly tell the difference between the two parties.   With the recent proposed zoning for Ravalli County, which was being financed  and pushed by out or state multi-national corporations, there was a huge stir among valley residents once  they became aware of how egregious and unconstitutional  the proposed zoning was. The plan was opposed by several different groups, each one claiming to have the best strategy to stop the unlawful taking of property rights with no compensation for those rights. My personal research led me to an altogether different solution, namely to repeal the growth policy. It was clear and simple to me that the law states that without a growth policy no zoning can be implemented.

The truth is that when I submitted the petition to repeal the growth policy, I was opposed by both Democrat and Republican elected officials.  It really started with Lee Foss; who was much more of a force against the repeal than even The Friends of the Bitterroot.  He did a good job touting anti-zoning rhetoric, but in fact he wouldn’t sign the growth policy repeal or gather signatures to get it on the ballot.  He instead helped start a group called CPR, which was lead by Dallas Erickson.  They wanted to only give a right to vote on zoning, not stop the anti-property rights agenda.  This was clearly a trick since if you vote on zoning everyone in the cities would also get to vote even though it was county only issue, a sure loss.  If you vote on the growth policy, only county residents who would fall under the zoning would get to vote on it, a sure win.   Interestingly, both of these gentlemen (Lee Foss and Dallas Erickson) stood in front of the Ravalli County Central Committee and pleaded with them to reverse their unanimous decision to support repeal of the growth policy. Furthermore, your property rights are God given and inalienable and set forth in the US Constitution and the Bill or Rights. They are not up to a vote. If you were able to vote another’s rights away, what would be to stop you from voting away the right to bear arms, free speech, or freedom of religion, etc.

The majority of the Ravalli County Republican Central Committee stood strong for your property rights, but the elected legislators and many others were opposed to protecting these rights.  The Democrat central committee was overwhelmingly for taking your property rights.  Most of the elected officials in both parties tried to coax everyone to stop the repeal, because it would hurt their election campaigns (not to mention most of them are for zoning).   If they won’t stand for your property rights why are they representing you, since they all refused to help gather signatures and not one of them would sign the Repeal of the Growth Policy petition?

We all saw what happened in the Primary Election this year over 81% of all the voters voted on the Republican ticket.  Why? Because the Democrats all know that they have a hard time getting elected, so they run Democrats as Republicans.  Then a majority of the Democrats vote on the Republican Ticket and like magic most of the Constitutional Republicans get voted out in the primary.  So you may ask why I am running.  Simply because I believe one person can make a difference by giving you a real choice.   You have only two choices in this election: vote for the one party system that has let you down time and again, or vote to restore liberty and vote Libertarian.

Democrats Steal Republican Primary in Montana and More

The Ravalli County, Montana Libertarian Party has posted some informative articles, the title of which will say what happened when (except for Ravalli’s Ron Stoltz and other true conservatives) the RINO’s won nearly every time statewide in the June Primary Elections.

Besides the Democrats (due to “open” Primary in MT) voting for RINO’s so that their agenda is achieved regardless of who wins in November, this is mixed with a rather (voluntarily) uninformed public, who are unfortunately only capable of absorbing manipulated mainstream media exposure and picking from two choices: the Red Elephant “R” or the Blue Donkey “D” and nothing else. They haven’t noticed over the last 100 years, and especially in the last 40 years, that they are now the same party.

With few exceptions (Ron Paul comes to mind), it is really becoming a choice between “Retard” and “Dumb.”  And unfortunately, this describes the typical voter, not the politicians – as the politicians absolutely know what they are doing!  And that the majority of the population doesn’t even vote (due mostly to feeling powerless), this can even be a worse problem.

However, nearly everyone (whether they exercise their right to vote or not) is a taxpayer – and those smart, consuming (no, devouring) politicians look for many ways to get into your pocket and endlessly spend, so that they themselves (or their friends) don’t have to do any productive work, but live off of your back, while giving mere breadcrumbs to those they claim to be helping.  You think we would better monitor how our hard-earned money is spent, and when it is being squandered (stolen), to do something about it.

Since RINO’s are now dominating the Republican ticket (again) – voting “L” for Libertarian locally in November is our only hope of getting our liberties, and our property, back!

How can we educate voters (or should I say, our neighbors)?  How can we inspire them to care to register to vote – and then to actually vote, and do so knowledgeably?  How can we feel like we really are making a difference?  It starts with us, and then we need to share with others, and then they feel inspired to also share with others, etcetera, etcetera.  Let’s DO THIS!!

First, we have some Montana Candidate information coming up.  For starters, we are enthusiastic for a REAL alternative to Denny Rehberg with Mark French! Take a look!  Later, we hope to post videos with candidate interviews, so you can easily review the candidates and their positions for yourselves – something the mainstream news doesn’t really allow us to do.

Denny Rehberg Is Not For Liberty

There is plenty of internet coverage of Senator Max Baucus giving his girlfriend an unjustified $14,000 raise, so we won’t bore you here.  The most incredible and yet entirely predictable thing is the nonchalance of the Democrats.  If a Republican were to do this, it is nearly guaranteed there would be a lot more stink about it on MSM.  What have we learned?  Be careful which party you choose when you decide to have scandals.  In general, the Democrats tend to get away with plenty more than the Republicans do.

As we all know, everyone has had their utter concentration on the costly, inefficient and perhaps deadly Health Care Bill (ObamaCare) as of late.  The creators of this 2,000 page document will stop at nothing to cram this down the American throat, whether Americans want it or not.  Even the Americans who think they want it haven’t read it, and if they did:  they either have something themselves to gain from it, or they would vote against it.  Even Jon Tester has created a series of emails, pretending that the proposed Health Care would actually help Montanans, using isolated personal stories that are unfortunately void of the hard facts and the larger picture.

But today – the House slid a fast one on us.  They knew it too.

While Mr. Rehberg likely identifies himself as a Conservative, Montanans who consider themselves Liberty-oriented, be it anything from Libertarians to “Ron Paul Conservatives” as well as wide-ranging political affiliation descriptions; will be quite disappointed in this news:

He voted for extending the already-liberty-robbing Patriot Act today.

Here is the Voting Results.  It is so sad there are only 34 Patriots, and how embarrassing that 23 of those were Democrat!  Shame on the Fake Republicans!

Liberty-minded Montana voters have had it up and over and beyond with Washington’s rhetoric of their “protection” of us, when what is practiced is the exact opposite of that.  We are tired of having our freedoms stripped away and constant invasions of our privacy.  We wonder – is Mr. Rehberg also in favor of the Real ID Act?

True Conservative voters need to take this into consideration at election time, as well as foster new candidate(s) who are about restoring our liberties, according to the US and the Montana Constitution – we cannot settle for less!

The Office of Montana’s Secretary of State Has Accepted a Draft Ballot Initiative Seeking to Provide the Citizens of Montana the Ability to Summon Grand Juries By Petition

Stevensville, Montana, November 10, 2009 – The office of Montana’s Secretary of State (SOS) in Helena has accepted a ballot initiative, to be reviewed by the office of Legislative Services. This is the beginning stage of placing the initiative on the 2010 general election ballot.

This initiative has been labeled ‘Ballot Issue #18’ by the SOS, and is a Constitutional Initiative (CI), seeking to amend Montana’s Constitution, providing for the ability of the citizens to summon Grand Juries by petition.

Currently, the Montana Constitution only provides that a District Judge, at their discretion, may summon a Grand Jury. Article II, Section 20, Paragraph 2 states: “A grand jury shall consist of eleven persons, of whom eight must concur to find an indictment. A grand jury shall be drawn and summoned only at the discretion and order of the district judge.”

Serving as a ‘check and balance’ for the Constitutional Republic known as the United States, the Founders had preserved for the citizens, the right and ability to assure that the public servants kept their activities in line with the intent of the Constitution, and its Bill of Rights, which were ratified on December 15, 1791. The term Grand Jury is mentioned only in the 5th amendment to the United States Constitution. It is meant to be a right retained by the people. It is a citizen function, not a government function, as the public has been lead to believe.

What do the courts have to say?

“An independent grand jury is to stand between the prosecutor and the accused, and to determine whether a charge is legitimate, or is dictated by malice or personal ill will.”

”Hale v. Henkel, 201 U.S. 43 (1906)

The Supreme Court states that the independent grand jury’s purpose is not only to investigate possible criminal conduct, but to act as a “protector of citizens against arbitrary and oppressive governmental action,” and to perform its functions; the independent grand jury “deliberates in secret and may determine alone the course of its inquiry.”

United States v. Calandra, 414 U.S. 338 (1974)

Article IV, Section 4 of The United States Constitution says: “The United States shall guarantee to every State in this Union a Republican Form of Government …” And, Montana is this form of government. As such, the Montana Constitution states in Section 1: “Popular sovereignty. All political power is vested in and derived from the people. All government of right originates with the people, is founded upon their will only, and is instituted solely for the good of the whole.”

And, in Section 2: “Self-government. The people have the exclusive right of governing themselves as a free, sovereign, and independent state. They may alter or abolish the constitution and form of government whenever they deem it necessary.”

The Founders’ intended for the sovereign citizens to ‘lend’ the public servants their specific duties. Among these is the preservation of constitutionally protected rights. The servants are not in a position, and do not have the ability to take away these sovereign, constitutionally secured rights and powers of the people.

Amending Montana’s Constitution as indicated will serve to restore the Founders’ intent, at the state level, regarding the position of, and political responsibilities required by, the citizenry.
